WHEREAS, the undersigned applicant (hereinafter referred to as the “applicant”) is applying for membership in the WDDIGKO, and…
WHEREAS, the risks associated with learning and practicing karate have been disclosed to the applicant, and the applicant understands and acknowledges the risks but still wishes to continue to learn and practice karate and apply for membership, NOW THEREFORE, for and in consideration of the sum of the annual dues and other good and valuable consideration, the parties agree as follows.
1. Applicant certifies that applicant has attained a lawful age (18 years and older). (If not, both applicant and applicant’s parents must sign below.) Applicant hereby agrees that in consideration of being given full rights and privileges of membership in WDDIGKO and for other good and valuable consideration, to the following. Applicant shall hereafter and forever fully release and indemnify WDDIGKO, its founder, directors, officers, instructors, agents, and employees from any cause of action, claim, or liability for damages or expenses, including but not limited to any claims for personal injuries, resulting from or arising out of anything, including without limitation any negligence, which may result from applicant’s membership in WDDIGKO, applicant’s participation in WDDIGKO activities, or applicant’s use or lack of use of karate techniques utilized or attempted to be utilized. Applicant hereby voluntarily releases, discharges, waives, and relinquishes any and all actions or causes of action for personal injury, property damage, or wrongful death occurring to applicant as a result of applicants membership in WDDIGKO, applicant’s participation in WDDIGKO related activities or any activities incidental thereto wherever or however the same may occur. Applicant, for themselves, their heirs, executors, administrators, and assigns hereby releases, discharges, waives, and relinquishes any and all actions or causes of action, aforesaid, which may hereafter arise for applicant and for applicant’s estate, and agrees that under no circumstances will applicant or applicant’s heirs, executors, administrators, and assigns prosecute or present any claim for personal injury, property damage, or wrongful death against WDDIGKO, its facilities, or any of its officers, instructors, agents, or employees for any of said causes of action, whether the same shall arise by negligence of any said persons, or otherwise.
IT IS APPLICANT’S INTENTION BY THIS INSTRUMENT TO EXEMPT AND RELIEVE THE WDDIGKO, THEIR RESPECTIVE OFFICERS, INSTRUCTORS, AGENTS OR EMPLOYEES, FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE.
2. Applicant warrants that applicant is in general good health and physical condition, and that to the best of the applicant’s knowledge, applicant does not suffer from high blood pressure, heart ailments, or any latent physical disabilities. Applicant acknowledges that applicant is fully aware and expressly understands that training and instruction in karate requires strenuous exercise and activity and necessitates bodily contact during sparring and at other times as a part of the instruction, and applicant is fully aware that any and all of the aforementioned activities and others may result either unavoidably or negligently in bodily injury to applicant. Membership in WDDIGKO and participation in WDDIGKO related activities is the applicant’s choice, and applicant is encouraged not to join or participate if applicant wishes to avoid the inherent risks.
3. Applicant agrees to use karate techniques only for self defense, instruction, exercise, self improvement, or to help others. Applicant certifies that the information supplied by the applicant in the membership application is true and complete. Applicant agrees to abide by the code of ethics, principles, or bylaws of WDDIGKO. Applicant agrees that applicant’s membership may be revoked without remuneration at any time if the applicant fails to abide by the code of ethics, principles, or bylaws of WSGKO. Applicant agrees that applicant’s membership may be revoked without remuneration at any time if WDDIGKO finds that the applicant has engaged in conduct materially and seriously prejudicial or detrimental to the interests or purposes of WDDIGKO.
4. In the event of any litigation arising out of this agreement or out of the applicant’s membership in WDDIGKO or participation in WDDIGKO related activities, the applicant agrees to, at WDDIGKO’s sole option, either (a) advance to WDDIGKO the legal fees and costs estimated to be incurred by WDDIGKO, or (b) reimburse WDDIGKO the legal fees and costs actually incurred by WDDIGKO. Applicant acknowledges and agrees that participation by applicant in karate and in karate related activities may result in damages (including but not limited to bodily injury or death) to applicant which are difficult or impossible to determine exactly. Accordingly, applicant agrees that, in the event a court of law determines that applicant’s membership in WDDIGKO or applicant’s participation in WDDIGKO related activities resulted to damages to applicant, liability for such damages shall be limited to a sum not to exceed the annual dues paid by the applicant for membership, and in any event applicant agrees to accept a sum not to exceed the annual dues paid by the applicant as complete liquidated damages.
5. This agreement shall not by construed against its drafter. The terms of this agreement shall survive any termination of applicant’s membership in WDDIGKO. If any part of this agreement is contrary to or prohibited by or deemed invalid under applicable laws, the remaining parts shall remain and be construed in full force and effect to the extent permitted by law. This agreement shall be construed in accordance with the laws of the United States of America. This agreement shall be binding upon and inure to the benefit of the parties, their respective heirs, successors, personal representatives, and assigns. Applicant acknowledges having read this agreement and understanding all of its terms. Applicant executes this agreement voluntarily and with full knowledge of its significance. In agreement with all of the above and foregoing, the parties have signed below.
In order to achieve rank or any certification in the World Double Dragon Institute Goju-Ryu Karate Organization one must be a current member on file with annual dues paid to date. The organizational annual dues are listed on the membership application. Payment is made in accordance with the information on the application form. Copies of the membership application are located in the back of this handbook. On receipt of the membership application, approved members will then receive a receipt by mail which is proof of their good standing.
All memberships expire December 31 of each year and must be renewed before then. It is the responsibility of the member to renew his or her membership before expiration. A $25 late payment filing fee for reactivation of a late membership renewal will be charged and should be added to membership dues if the renewal is submitted late. Memberships and dues are based on a calendar year and are not prorated. Full payment should be submitted regardless of when the application is submitted during the year. All students who join the Double Dragon Institute of Goju-Ryu Karate-do Organization in November or December will not owe dues until the following year unless they take a rank test.
